At first I felt bad for him when he was saying this in court. That maybe the bank had scammed them to force a foreclosure.
Then I realized that if that were true, he should still have 3 months worth of payments in the bank. That didn't seem to be the case if they were making such a big deal about having $250 and didn't have enough money to get another apartment. So obviously they were still negligent on their payments. -

I Googled some stuff To avoid foreclosure people apply for a loan modification thru their mortgage company and sometimes to be eligible u have to be behind on ur payments. So they're told to stop making payments. And yes in theory he should have his 3 months in his pocket but when u have other bills and such, u pay on those too so he probably spent it all.

This is true, I had to do this back in 2009. The bank had us miss payments to basically show a hardship and then they modified the loan to make it more affordable. This was very common during the housing crisis.
