They could just call it "quarantine" and probably get away with it. The Constitution has virtually been suspended.
With the Japanese, I could see interning aliens during the war. But they actually imprisoned Japanese-American citizens. A clear violation of the Bill of Rights. Their homes were vandalized and their property stolen.
