    Tommy's story about meeting Elmo and Elmo telling what happened to the wife would mean nothing. It would be hearsay and not even that. In the one case where the Warden is being logical, he's being logical here. Tommy is best friends with Andy and it would not be taken seriously. All of Andy's friends could claim they heard someone admitting to the crime. That part of this movie is a flaw.

        What I find odd is that Andy, who is supposed to be this real smart and calm and collected guy, goes to the Warden with this instead of requesting a lawyer.
        The Warden could not have done anything at all to help him get out of prison and that is not in his interest.
        Through the movie we see what a hard nose and a dick he is to the prisoners, so why would Andy all of a sudden think of him like a friend when he never was to any of them?

          Perhaps Andy thought that because he had laundered the Warden’s money that he could use this as leverage, he also underestimated just how corrupt the warden really was.
