Are you serious? First of all, Forrest isn't really retarded. He was slow. Second of all, if Forrest didn't want to have sex with her, I'm sure Jenny would of stopped. They both said they loved each other and then they made love. People with a IQ of 75 can have sex as long as it's consensual and they aren't underage. It's wasn't rape.

Some states might have laws against having sex with a mentally retarded person BUT because Forrest was BORDERLINE mentally retarded most likely the law would have given benefit of the doubt and there was no crime. It is also possible that his IQ was slightly above the legal dividing line for mental retardation.
I read a fictional book once that so reminded me of this movie that I wish it had been made into a movie. It was called LOTTERY and it was about a person with very low functioning who wins 12 million dollars in a state lottery and suddenly his family who have either ignored him or been very cruel to him suddenly are very nice to him trying to swindle him out of the money but he has good friends who act as his advocates to protect him from that.
Anyway the main character in LOTTERY had an IQ that was exactly one point over the legal dividing line and he would proudly point out that he was NOT mentally retarded because his IQ was just above the line.
Legality is about exact dividing lines. It may seem silly that it's legal to sleep with someone on their 18th birthday but not even one day before but a line has to be drawn somewhere for laws to work in our complex world and Forrest was I believe slightly above the dividing line for mental retardation.
If you really want to get angry at a woman for effectively committing statutory rape on a mentally retarded man you MUST see I AM SAM, she gets pregnant and then takes off sticking him with the baby and paying no child support! -

The use of rape in this sense is quite modern, but this question isn't that absurd in the context of current society's obsession with "rape culture" and making almost all sex considered rape under the broadest terms.

You must have missed the ever so emotional and - for the development of the characters aswell as the story - poignant "I may not be a smart man, but I know what love is."
Forrest might not know every little thing there is to know about the birds and the bees - and compared to the very experienced Jenny he was definately a novice. But he loves her and wants to spend the rest of his life with her. And he is also strong and fast, and could certainly object forcefully if something happened that he was not ok with.
Meaning: There was no rape. -
