Quite simply, Ace was not a contracted member of the band anymore. Tommy Thayer was and is the guitarist under contract with the band

Too bad Gene's such a prick. A good case could be made that without Ace & Peter returning in makeup (circa 1995), KISS would have been irrelevant by 2000.

KISS has been irrelevant since the end of the Farewell tour to me, ooh but there's a tribute band named KISS! Let's see, its members are Gene Simmons, Paul Stanley, Eric Singer, and some former lackey on lead guitar.
